Bookings Terms and Conditions

These terms and conditions form the basis of the agreement between David Saint and Travel Companions regarding the booking of the holiday and lifestyle packages in the Travel Bag.

David Saint cannot guarantee that the information relating to pricing, itineraries and availability will remain unchanged after publication on this website.

1. BOOKINGS

  1. Bookings are confirmed on condition that at the time when a booking is made there is a minimum balance of 70% of the package booked in the Travel Bucks™ Account which will be used as a deposit towards land price and a full payment in respect of the airfare.

  2. David Saint will thereupon make payment, within one (1) business day of confirmation of any booking, to the airline, failing which the airline will automatically cancel such booking.

  3. Travel Companions will be advised at the time of booking as to the Travel Bucks™ required for the said booking. The balance in respect of Travel Bucks™ in the Travel Bucks™ Account must be accumulated no less than eight weeks prior to departure.

  4. If bookings are made within eight weeks of departure, the full Travel Bucks™ must be available in the Travel Bucks™ Account at the time of booking.

2. FLUCTUATIONS

  1. The cost associated with the travel arrangements are not always stable, and currency movements can fluctuate. It is therefore impossible to predict these movements in advance. David Saint therefore reserves the right to pass on any fluctuations and surcharges to Travel Companions until full value of the booking is covered  by Travel Bucks™ in the Travel Bucks™ Account.

  2. Surcharges may be imposed to cover increases in transportation costs, including the costs of fuel and security charges, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports, or exchange rates applied to the travel arrangements.

  3. Peak season surcharges and block out dates may apply.

  4. Airfares are subject to the prices and conditions quoted by the particular airlines and cannot be guaranteed by David Saint.

3. FLIGHT AND OTHER TRAVEL TIMINGS

  1. Flight timings are provided by airlines and are subject to Air Traffic Control restrictions. All means of transportation are subject to weather conditions, the need for constant maintenance, and the ability of passengers to check-in on time.

  2. David Saint does not guarantee that flights, ferries, ships, trains, or coaches will depart at the times stated in any itinerary or tickets. All timings are estimates only, and David Saint does not accept any liability for any delay, however arising, or for any schedule alterations.

4. UNSCHEDULED EXTENSIONS

  1. In the unlikely event of there being unscheduled extensions to any travel arrangements caused by flight delays, bad weather, strikes, or any other cause which is beyond the control of David Saint, it is understood that the expenses relating to these unscheduled extensions, (hotel accommodation, airline costs, car hire, transfers, etc.), will be for clients’ account. David Saint does not accept any liability for changes, omissions, or delays before or during the course of any travel arrangements occasioned by technical difficulties, weather conditions, strikes, epidemics or communication breakdowns or the like.

5. CHANGES MADE BY CLIENTS

  1. Should Travel Companions wish to make any changes to the bookings prior departure, David Saint will endeavor to assist to make the change(s) wherever this is possible. Travel Companions are therefore responsible for all charges, of whatever kind, imposed by the suppliers providing that component part of the travel arrangements.

  2. Travel Companions understand that after departure any extra expenses incurred as a result of any changes will be their responsibility, and no refunds will be made for any unused service.

6. INSURANCE

  1. David Saint recommends that adequate insurance cover should be taken for unforeseen circumstances such as cancellation due to illness, worldwide epidemics such as SARS, Coronavirus, etc., accident or injury, personal accident and personal liability, loss of or damage to baggage and sports equipment.

  2. Should, at the time when a claim is made, the insurers dispute their liability for any reason, the Travel Companion will have recourse against the insurers only. 

7. DOCUMENTS

  1. Documents are only prepared on receipt of full payment of any travel arrangements with Booking Form and Indemnity Form completed and signed. These will be ready and made available within one (1) business day after the required Travel Bucks™ are redeemed for payment.

  2. It is the responsibility of Travel Companions to check all details of their travel documents, including the itinerary, especially for international travel, before leaving South Africa.

  3. Should there be any inaccuracies on any of the travel documents, or should Travel Companions have any further queries, they should contact David Saint immediately as David Saint cannot be held liable for any delay and/or loss occasioned as a result of any inaccuracies on any travel documents once clients are in receipt thereof and have already left South Africa.

8. CANCELLATIONS MADE BY TRAVEL COMPANIONS 

Should Travel Companions wish to cancel their bookings they must notify David Saint immediately and cancellation charges which include but not limited to the following will apply:

  1. Any charge imposed by suppliers of various components of the travel package including airfare, hotel price etc.

  2. David Saint also charges a cancellation fee equal to 10% of the package price on any finalised booking. This is in addition to any charges raised by the suppliers.   However, David Saint reserves the right to charge an alternative appropriate cancellation fee in its sole discretion, in particular circumstances where 10% fee may not adequately cover costs or specific terms apply

  3. . Any payment which the Travel Companion has already made in respect of Travel Bucks™ will be regarded as payment or part payment of any cancellation charges.

9. DAVID SAINT'S RIGHT TO CHANGE ANY TRAVEL ARRANGEMENT 

  1. ​A significant change to any travel arrangements would include a change in the departure date from South Africa due to changes in flight times by more than 12 hours or change to a lower standard of accommodation to that which is booked.

  2. David Saint will make every effort to adhere to confirmed itineraries. However, David Saint reserves the right to make changes to any travel arrangements should it become necessary to do so.

  3. Sould David Saint confirm any component of the travel arrangement and consequently be cancelled by the supplier of the said component of the travel arrangement, David Saint cannot be held liable for such cancellations.

10. AIRLINE REFUND PROCEDURES

  1. Refund policies of the various airlines vary between airlines. Tickets returned to David Saint, will be presented to the relevant airline for assessment. Should a refund be authorised, such refund will be credited to Travel Companions  Travel Bucks™ Account less any cancellation or administration charges imposed by the airline.

  2. Although David Saint cannot guarantee this – it may take up to 12 weeks for the airline to process the refund.

  3. Unused tickets must be returned to David Saint for a refund within one year from the date of issue or they will be regarded as expired by the airline and have no refund value.

11. COMPLAINTS

  1. Travel Companions should immediately inform the supplier of the services in question should they experience any problems whilst on holiday, especially on international travel.

  2. Travel Companions should contact David Saint immediately if the problem is not resolved satisfactorily so that David Saint can step in and solve the problem to the clients’ satisfaction.

  3. Should Travel Companions still be dissatisfied they should thereupon contact the  Customer Care Manager within 28 days of the unsatisfactory service, and provide booking reference and full nature of the complaint by email at care@davidsaint.africa.

12. PASSPORTS AND VISA

  1. Travel Companions have a responsibility of ensuring that their VISAs are current, valid and obtained on time.

  2. Travel Companions should also ensure that passports are valid for 6 months after return to South Africa.

  3. Travel Companions must ensure that the details supplied to David Saint reflect those shown on their passport and VISA for international travel and ID documents for local travel.

13. HEALTH AND MEDICAL MATTERS

  1. Travel Companions should ensure that they have received the necessary vaccinations, inoculations, prophylactics (e.g. for malaria) and the like, and provide proof when required.

  2. David Saint will not assume any obligation or liability for the Travel Companion's non compliance. Travel Companions should also indemnify David Saint against any consequences of non-compliance.

  3. Travel Companions have a duty to familiarise themselves with the inherent dangers of any mental and/or physical condition required for the proposed travel arrangements.

  4. Travel Companions who have medical or disability problems which may affect their travel must provide David Saint with full details of such problems in writing at the time of booking. Should David Saint reasonably feel unable to properly accommodate the particular needs of the person concerned David Saint reserves the right to decline their reservation. David Saint also reserves the right to cancel the reservation should David Saint become aware of any such medical problem or disability which has not been disclosed.

14. GENERAL INFORMATION

  1. Taxes: David Saint will advise Travel Companions of all mandatory taxes which must be paid before departure. However, many countries charge departure taxes that can only be paid locally. David Saint therefore recommends that Travel Companions should retain sufficient local currency to meet such charges and David Saint will provide clients with details of such charges prior departure.

  2. Special requests: David Saint will pass on any special requests that Travel Companions may have upon making bookings. However, acceptance of such requests is at the discretion of the airline or other supplier and in no circumstances, are special requests guaranteed. Confirmation that a special request has been noted or passed on to the supplier, or the inclusion of the special request on clients’ confirmation invoice or any other documentation, is not confirmation that the supplier has met such a request.

  3. Renovations: Hotels undergo renovations from time to time and take all possible steps to limit disruption to their guests. David Saint cannot therefore entertain complaints or requests for refunds if a hotel is carrying out renovations whilst a guest is resident. Should a hotel advise David Saint of such renovations, Travel Companions will duly be informed.

  4. Confidentiality: David Saint undertakes to be fully compliant with legislation such POPIA and many other relevant legislation and as such deal with clients in strictest confidence.

15. FORCE MAJEURE

  1. Except where otherwise expressly stated in these booking conditions, David Saint cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected, or clients otherwise suffer any damage or loss, as a result of “force majeure”. In these Booking Terms and Conditions, “force majeure” means any event which David Saint or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may also include war or threat of war, riot, civil strife, terrorist activity or actual threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, epidemics such as SARS, Coronavirus and the like, fire and all similar events outside our control.

16. RESPONSIBILITY AND LIMITATION OF LIABILITY

  1. David Saint acts as an agent only for local and international ground operators and airlines and accordingly accepts no liability whatsoever for any loss, damage, injury, accident, delay, or any other irregularity howsoever arising.

  2. David Saint makes every effort to ensure that all the arrangements and services connected with a passenger’s itinerary will be carried out as specified in the most efficient and effective way possible. However, David Saint does not have direct control over the provision of services by suppliers and, whilst they are in all cases selected with the utmost care, David Saint does not accept liability for errors and omissions of such suppliers. 

17. LEGAL

  1. These Terms and Conditions together with David Saint standard booking form, invoice and itinerary constitute the sole record of the agreement between the parties.

  2. No party shall be bound by any representation, warranty, and promise of the like not recorded herein. Travel Companions acknowledge that they have not relied on any matter or thing stated on behalf of David Saint or otherwise that is not included herein.

  3. No addition to the David Saint Booking Terms and Conditions shall be of any force or effect unless in writing and signed by or on behalf of the parties.

  4. All costs and disbursements, including any legal costs incurred by David Saint in recovering any damages and payments payable by Travel Companions to David Saint shall be the Travel Companion"s responsibility.

  5. This agreement shall in all respects be governed by and construed in accordance with the laws of the Republic of South Africa.

18. AUTHORITY TO BOOK AND REDEEM TRAVEL BUCKS™

  1. Only Travel Companions have authority to make any booking and also authorise David Saint to debit the  required Travel Bucks™ from  the Travel Bucks™ Account for a booking made in the Travel Bag.

19. COPYRIGHT

  1. Any visual, whether it be a video, a photograph, or an illustration, used by David Saint are copyrighted and are therefore not to be used or replicated in anyway without prior consent by David Saint or the supplier. Visuals reflected on any of David Saint marketing materials or otherwise are a representation only as some images have been enhanced for effect.​​
