This appendix covers the Terms and Conditions of the Travel Companion's participation in David Saint Advantage. These Terms and Conditions, together with the Travel Bucks™ Purchase and Travel Companion Registration, Travel Bucks™ Terms and Conditions, Bookings Terms and Conditions, and any related policies form the basis of the agreement between David Saint and the Travel Companion regarding the Travel Companion's participation in David Saint Advantage.

For the purpose of these Terms and Conditions David Saint refers to David Saint (Pty) Ltd, a company duly incorporated in the Republic of South, a legal entity with which the Travel Companion concludes this Agreement. David Saint Advantage also refers to business venture and activities offered by David Saint as detailed in these Terms and Conditions, which enable Travel Companions to earn monthly income, bonus Travel Bucks™, extra Travel Bucks™, Shopping Bucks, and other benefits by promoting and selling David Saint Travel Bucks™ and referring others to do the same.

1. INTERPRETATION

In these Terms and Conditions, unless inconsistent with or otherwise indicated by context.

1.1 "Travel Companion" means any individual who participates in David Saint Advantage by subscribing to the Travel Bucks™ program through monthly payments known as Travel Bucks™ Fee, and engages in promotional, referral, and sales activities as an independent sales consultant. For clarity, references to "Member" shall be construed to mean "Travel Companion". Travel Companions therefore, are divided into two categories, viz:

"Associate Travel Companion" means a Travel Companion who is personally signed up and sponsored by another Travel Companion, forming the immediate referral line from whom the sponsoring Travel Companion may earn Monthly Income, bonus and extra Travel Bucks™, Shopping Bucks and other benefits.
"Group Travel Companion" means all Travel Companions in a Travel Companion's network or downline, extending down to the sixth level of referrals, from whom the Travel Companion may earn Monthly Income, bonus and extra Travel Bucks™, Shopping Bucks and other benefits.

1.2 "Travel Bucks™ Terms and Conditions" means the terms and conditions which are applicable and binding on the Travel Companion with regards to the purchase, accumulation and use of Travel Bucks™ and the booking of David Saint luxury holiday and lifestyle packages in the Travel Bag, which may be amended from time to time by David Saint at its sole discretion.

1.3 “Travel Bucks™ (TB)” means David Saint digital currency which is distributed through independent sales consultants also known as Travel Companions, and exclusively redeemable towards the luxury holiday and lifestyle packages in the Travel Bag. For a comprehensive definition of Travel Bucks™ refer to Travel Bucks™ Terms and Conditions, available on this website.

1.4 “Travel Bucks™ Plus (TB+)” means bonus Travel Bucks™ awarded to Travel Companions as part of David Saint Advantage Compensation Plan from the monthly Travel Bucks™ sales volume generated by their Associate Travel Companions and their Group Travel Companions down to the sixth level of referrals, which is credited and accumulates in the Travel Bucks™ Account and is subject to the same terms and conditions as purchased Travel Bucks™, and is exclusively redeemable towards the luxury holiday and lifestyle packages in the Travel Bag.

1.5 'Travel Bucks™ Xtra (TB×)" means extra Travel Bucks™ earned by Travel Companions as part of David Saint Advantage Compensation Plan, when their Associate and Group Travel Companions book the holiday and lifestyle packages in the Travel Bag and pay with their Travel Bucks™ in the Travel Bucks™ Account.

1.6 “Travel Bucks™ Account” means the individual Travel Companion's account where Travel Bucks™, Travel Bucks™ Plus, and Travel Bucks™ Xtra are credited and accumulate, and from which they can be redeemed towards the packages in the Travel Bag.

1.7 "Travel Bucks™ Plan" means a predefined monthly subscription category selected by the Travel Companion, which determines the amount of Travel Bucks™ credited to the Travel Bucks™ Account upon successful receipt of the corresponding Travel Bucks™ Fee.

1.8 “Travel Bucks™ Fee" means monthly subscriptions that Travel Companions make towards their Travel Bucks™.

1.9 "Shopping Bucks (sB)" means digital currency awarded to Travel Companions as part of David Saint Advantage Compensation Plan, when their Associate and Group Travel Companions book the holiday and lifestyle packages in the Travel Bag and pay with their Travel Bucks™ in the Travel Bucks™ Account. Shopping Bucks is credited and accumulates in the Travel Companion’s Shopping Bucks account and is used for payment towards groceries purchased on our online grocery store (coming soon).

1.10 “Membership Fee” means fees payable by Travel Companions on an annual basis at the time of signing up and at the anniversary of Membership, in order to participate in David Saint Advantage.

1.11 "Operational Support Fee" means fees payable by Travel Companions on a monthly basis for the operational support and ongoing administration provided by David Saint to manage and grow their business venture within David Saint Advantage.

1.12 “Monthly Income” means income payable to Travel Companions as contemplated in clause 4.3 below; being fees earned on monthly Travel Bucks™ subscriptions by the Travel Companion's Associate and Group Travel Companions. There are two types of incomes, namely Personal Income Rebate and Group Income Rebate.

"Personal Income Rebate (PIR)" means income earned by Travel Companions on a monthly basis from the monthly Travel Bucks™ sales volume generated by their Associate Travel Companions.
"Group Income (GIR)" means income earned by Travel Companions on a monthly basis from the monthly Travel Bucks™ sales volume generated by their Group Travel Companions down to the sixth level of referrals.

1.13 “Product” means the Travel Bucks™ and luxury holiday and lifestyle packages in the Travel Bag.

1.14 “Membership” means the participation of the Travel Companion in David Saint Advantage.

1.15 “Terms and Conditions” means the terms and conditions applicable to David Saint Advantage as set out herein, together with all annexures hereto.

1.16 Any reference to the singular includes the plural and vice versa.

1.17 Any reference to natural persons includes legal persons and vice versa.

1.18 Any reference to a gender includes the other gender and vice versa.

2. MEMBERSHIP TERMS AND CONDITIONS

2.1 A person who is 18 years of age or older, and who has been provided with a Business License shall be deemed to be a Travel Companion as a result of their participation in David Saint Advantage and the Terms and Conditions set out herein shall be binding upon him.

2.2 A Travel Companion must be a permanent resident of South Africa, in possession of a valid South African ID document or passport, irrespective of being a South African citizen.

2.3 David Saint shall be entitled at any time to amend any of the Terms and Conditions on 30 days written notice to the Travel Companions, at any of their chosen email addresses set out in the Travel Bucks™ Purchase and Travel Companion Registration Form, or through any method which David Saint may deem appropriate.

3. RELATIONSHIP BETWEEN THE PARTIES

3.1 The legal relationship between David Saint (Pty) Ltd and the Travel Companion is that of an independent contractor. Nothing in this Agreement shall be construed to create employment, partnership, joint venture, or agency relationship between the parties.

3.2 Neither party shall have authority to bind or obligate the other to any third party without prior written consent. Any unauthorized commitments or representations shall be deemed void and the responsible party indemnifies the other for any resulting losses.

3.3 In the event that the Travel Companion misrepresents their relationship with David Saint, the Travel Companion agrees to indemnify David Saint for any losses it may suffer.

4. BUSINESS VENTURE

4.1 The Travel Companion shall introduce clients who purchase Travel Bucks™, who are also independent sales consultants, by signing up to David Saint Advantage, by showing them the relevant marketing materials and showing them the presentation in accordance with the Terms and Conditions. These clients/sales consultants are referred to as Travel Companions.

4.2 The Travel Companion shall conduct their sales and introduction services in compliance with David Saint Advantage policies and procedures, and shall only utilize marketing materials, presentation, claims, statements, disclosures, representations, or warranties as provided or expressly authorised in writing by David Saint. The Travel Companion shall not make any claims, statements, or representations about David Saint Advantage or Products that are not contained within David Saint Advantage official materials.

4.3 The Travel Companion is entitled to Monthly Income, calculated based on the Travel Bucks™ Fee received by David Saint from their Associate Travel Companions and Group Travel Companions up to the sixth level, subject to the Travel Companion’s compliance with the Terms and Conditions.

4.4 The entitlement to Monthly Income will commence once the Travel Companion has a minimum of one (1) Travel Bucks™ Fee paying Associate Travel Companion. The specific categories and levels of Monthly Income and their associated qualifications, including any maximum on directly referred Travel Companions required for certain categories are detailed in the David Saint Advantage Compensation Plan, which is incorporated by reference to these Terms and Conditions.

4.5 Monthly Income shall only be payable on receipt of each Travel Companions' Travel Bucks™ Fee on a monthly basis as contemplated in clause 4.3 above.

4.6 Monthly Income payments shall be made by electronic funds transfer (EFT) to the bank account nominated by the Travel Companion. Payments will be made on or about the 15th day of each month, subject to receipt of Travel Bucks™ Fee and verification of eligibility. David Saint reserves the right to amend the payment date upon 30 days’ prior written notice.

4.7 The Travel Companion shall also be entitled to monthly reward system known as Travel Bucks™ Plus, calculated based on the sales volume generated by the monthly Travel Bucks™ Fee payments from their Associate Travel Companions and Group Travel Companions down to the sixth level of referrals, provided all the relevant Travel Bucks™ Fees have been duly paid.

4.8 The Travel Companion shall furthermore be entitled to Travel Bucks™ Xtra calculated and earned each time Associate and Group Travel Companions book the holiday and lifestyle packages in the Travel Bag.

4.9 Travel Bucks™ Plus and Travel Bucks™ Xtra shall be credited in the Travel Companion's Travel Bucks™ Account and accumulate together with purchased Travel Bucks™, and used solely for booking of the holiday and lifestyle packages in the Travel Bag.

4.10 The Travel Companion shall also be entitled to Shopping Bucks calculated and earned each time Associate and Group Travel Companions book the holiday and lifestyle packages in the Travel Bag.

4.11 Shopping Bucks is credited and accumulates in the Travel Companion’s Shopping Bucks account and is used solely for payment towards groceries purchased from David Saint online grocery store (coming soon).

4.12 The entitlement to Travel Bucks™ Plus, Travel Bucks™ Xtra, and Shopping Bucks commences once the Travel Companion has a minimum of one (1) Travel Bucks™ Fee paying Associate Travel Companion.

4.13 The entitlement to earn Monthly Income, Travel Bucks™ Plus, Travel Bucks™ Xtra, and Shopping Bucks is on condition that the Travel Companion's Travel Bucks™ Fee is up-to-date on a monthly basis.

4.14 Should the Travel Companion's Membership be terminated for whatever reason, they consequently forfeit all benefits in respect of their Monthly Income, Travel Bucks™ Plus, Travel Bucks™ Xtra, Shopping Bucks and/or any other benefit related to active Membership in David Saint Advantage.

4.15 Any balance of the Travel Bucks™ (both purchased and earned) remaining in their Travel Bucks™ Account at the time of termination shall not expire and may be used by the former Travel Companion at any future time to book any package(s) in the Travel Bag. For clarity, this non-expiry applies solely to the redemption of Travel Bucks™ for packages in the Travel Bag, and not to any other benefits or income-earning opportunities associated with active Membership in David Saint Advantage..

5. RESTRICTIONS AND LIMITATIONS

5.1 The Travel Companion shall not induce or solicit other Travel Companions to terminate their Membership or cancel their Travel Bucks™ subscriptions for the purpose of joining any competing business venture or product offering. Any breach shall be grounds for immediate termination of Membership and possible legal action.

5.2 The Travel Companion, their beneficiaries, or any other legal entity in which their beneficiaries has any direct or indirect interest, may not be a direct or indirect beneficiaries in David Saint Advantage more than once.

5.3 All media enquiries made to the Travel Companion must be referred directly to David Saint.

6. BONUSES AND REWARDS

6.1 The Travel Companion may qualify for bonuses and rewards paid over and above Monthly Income, Travel Bucks™ Plus and Travel Bucks™ Xtra and Shopping Bucks.

6.2 The bonus and rewards shall be based on the Travel Companion having achieved certain criteria as introduced by David Saint from time to time.

6.3 David Saint reserves the right to introduce or change the bonus structure at its sole discretion.

7. MEMBERSHIP FEE

7.1 The Travel Companion shall pay Membership Fee to David Saint in respect of their Membership in David Saint Advantage as determined by David Saint from time to time.

7.2 Membership Fee is payable at the time of signing up and annually on the anniversary of the Travel Companion’s Membership.

7.3 Membership Fee may escalate on an annual basis at the sole discretion of David Saint and the Travel Companion shall be informed of such escalation on 30 days prior written notice.

8. ADMINISTRATION AND SUPPORT

8.1 All operations, administration and support in respect of the Travel Companion's business venture in David Saint Advantage shall be conducted by David Saint on behalf of Travel Companions.

8.2 David Saint shall provide Travel Companions with monthly Travel Bucks™ Statement, setting out all transactions and Travel Bucks™ balances in the Travel Bucks™ Account.

8.3 David Saint shall also provide Travel Companions with Monthly Income Statement detailing their earnings within David Saint Advantage, based on the growth and activity of their network.

8.4 In order for David Saint to perform this important service to it's Travel Companions, a monthly Operational Support Fee is payable by Travel Companions by authorizing David Saint to deduct this from their Monthly Income.

9. TRAVEL BUCKS™ AND FINANCIAL SECURITY

9.1 All funds received in respect of Travel Bucks™ are held in a legally segregated Bank Trust Account.

9.2 Furthermore, all funds in respect of Travel Bucks™ Plus and Travel Bucks™ Xtra are also held in the Bank Trust Account.

9.3 The Bank Trust Account is subject to oversight by the Travel Bucks™ Management Committee (TBMC).

9.4 The TBMC also includes Travel Companion representatives, to protect Travel Companions' interests and ensure transparency, security, and proper management.

9.5 For comprehensive details regarding the management, protection, and operational procedures related to Travel Bucks™ and Bank Trust Account, including specific safeguards and verification processes, Travel Companions are directed to review the Travel Bucks™ Terms and Conditions available on this website.

9.6 It is the responsibility of the Travel Companion to familiarize themselves with these Terms and Conditions to accurately convey David Saint's commitment to prospective Travel Companions.

10. TAXATION

10.1 It is compulsory for the Travel Companion to register with SARS as a taxpayer in respect of the income earned from David Saint Pty (Ltd) through their participation in David Saint Advantage.

10.2 Travel Companions agree that they shall be solely responsible for any tax liability and for payments to SARS as a result of any income earned.

11. INDEMNITY

11.1 The Travel Companion indemnifies and holds David Saint harmless against all claims, demands, fines, penalties, actions, damages, proceedings, judgments, losses, theft, expenses or any other liabilities caused, whether negligently or otherwise, by the non-observance or non-compliance by the Travel Companion of their duties and obligations in terms of these Terms and Conditions.

12. TRAVEL COMPANIONS DUTIES AND OBLIGATIONS

The Travel Companion agrees to the following:

12.1 That referrals shall be done exclusively to David Saint based on these Terms and Conditions and the Travel Bucks™ Terms and Conditions.

12.2 That the use of media advertising in respect of the Travel Bucks™ subscription and David Saint Advantage is strictly prohibited other than through David Saint itself.

12.3 That no misleading, deceptive or unfair selling and recruiting methods will be utilized.

12.4 That no claims, statements, disclosures, representations or warranties of whatsoever nature which are not printed on David Saint materials will be made by the Travel Companions. The materials will be retained in their proper context and form and will not be distorted to be misrepresented or misleading in any manner or form.

12.5 That the Travel Companion will abide by all applicable laws and regulations relating to David Saint Advantage.

12.6 That the Travel Companion will not bring David Saint name into disrepute through their acts of commission or omissions.

12.7 That the Travel Companion will pay the Travel Bucks™ Fee by the 7th of each calendar month, covering the monthly period which runs from the 8th of the preceding month to the 7th of the current month.

12.8 That non-payment of Travel Bucks™ Fee will result in no Travel Bucks™ being credited to the Travel Bucks™ Account. Furthermore the Travel Companion will also not earn any Monthly Income, Travel Bucks™ Plus and Travel Bucks™ Xtra.

13. BENEFICIARY AND ESTATE INHERITANCE

13.1 Upon the death of the Travel Companion, their Travel Companion status within David Saint Advantage is automatically terminated.

13.2 In the event that a valid beneficiary has been nominated by the deceased Travel Companion in a form acceptable to David Saint Advantage, such nominated beneficiary shall inherit:

Any accumulated Travel Bucks™ in the deceased Travel Companion's Travel Bucks™ Account at the time of their death.
Any Monthly Income and bonuses due to the deceased Travel Companion at the time of their death.

13.3 A nominated beneficiary may, at their sole discretion, within a month of the the death of a deceased Travel Companion, apply to become an active Travel Companion, subject to agreeing to be bound by the then-current David Saint Advantage Terms and Conditions. Whereupon, the nominated beneficiary will assume the deceased Travel Companion's active status within the business venture, including any associated future earning rights, from the date of their official acceptance as Travel Companion.

13.4 Should a nominated beneficiary not wish to become a Travel Companion, or if they do not meet the eligibility criteria to become a Travel Companion, they shall nonetheless be entitled to the inherited Travel Bucks™ balance.

13.5 This inherited Travel Bucks™ balance shall remain valid indefinitely as per the Terms and Conditions. In such a case David Saint shall, upon receiving a booking, and verifying the identity and entitlement of the beneficiary, directly facilitate the redemption of the inherited Travel Bucks™ for holiday and lifestyle packages chosen by the beneficiary from the Travel Bag, subject to package availability and these Terms and Conditions.

13.6 The redemption process does not grant the beneficiary Travel Companion status or any associated rights or obligations beyond the specific use of the inherited Travel Bucks™ for package redemption.

13.7 Should no beneficiary be nominated by the deceased Travel Companion, their Monthly Income, Travel Bucks™, and bonuses due at the date of their death shall revert to the deceased Travel Companion's legal estate for distribution in accordance with the laws.

13.8 The duly appointed executor or administrator of the estate must, within twelve months from the date of confirmation of their legal authority by David Saint, nominate an individual beneficiary of the estate who is willing to utilize the Travel Bucks™ for redemption of Travel Bag packages. The nominated beneficiary will be subject to the Terms and Conditions outlined in clauses 13.5 and 13.6, as applicable.

13.9 Should the estate fail to nominate an eligible individual beneficiary who completes the required steps within the specified timeframe, or if no such individual can be identified or accepts the terms for redemption, the accumulated Travel Bucks™ shall be held by David Saint indefinitely, remaining valid but inaccessible until such time as an eligible individual is duly nominated by the estate and processes are completed in accordance with these Terms.

13.10 David Saint shall have no further obligation to actively seek beneficiaries for inherited Travel Bucks™ after the initial notification to the estate.

13.11 Travel Companions are strongly advised to nominate a valid beneficiary for their Travel Bucks™ Account and other entitlements within David Saint Advantage during the signing up process and keep the beneficiary information up-to-date at all times.

13.12 Nominating a beneficiary ensures a smoother and more direct transfer of inherited assets, significantly reducing potential delays, administrative complexities, and legal processes for their loved ones.

14. SALE OF STATUS

14.1 The Travel Companion may, subject to prior written approval by David Saint, dispose of his Travel Companion status to another person. The new Travel Companion will replace the previous Travel Companion for all purposes as the Travel Companion in David Saint Advantage.

14.2 The new Travel Companion must agree to be bound by the Terms and Conditions.

14.3 As of the date of the transaction these Terms and Conditions and the Travel Bucks™ Terms and Conditions will be applicable to new Travel Companion.

14.4 David Saint reserves the right to approve or decline the request to replace an existing Travel Companion with a new Travel Companion.

14.5 A written request, in a format prescribed by David Saint is required for the replacement of an existing Travel Companion with a new Travel Companion, including a business plan, where necessary.

14.6 By approving a new Travel Companion, David Saint does not comment on the validity of the transaction by the current Travel Companion to dispose of his status in favor of the new Travel Companion.

15. TERMINATION

Without prejudice to any right that David Saint may have in terms hereof or in law, the Membership of the Travel Companion in David Saint Advantage and any benefits payable in respect thereof may be terminated by David Saint with immediate effect, in the event that:

15.1 The Travel Companion is in breach of any provision of these Terms and Conditions or the Travel Bucks™ Terms and Conditions.

15.2 The Travel Companion, in the reasonable opinion of David Saint commits any fraudulent act in relation to David Saint Advantage, or any act that in the reasonable opinion of David Saint would or could have a detrimental effect on the name and goodwill of David Saint.

15.3 Inaccurate representations as to any potential or future expected Monthly Income, Travel Bucks™ Plus, Travel Bucks™ Xtra, Shopping Bucks, and bonuses to any prospective Travel Companion.

15.4 David Saint becomes aware that the Travel Companion is making false, misleading, or inaccurate representations as to any potential or future expected income and bonuses to any prospective Travel Companion.

15.5 The Travel Companion falsifies any documents or records required by David Saint, including but not limited to the Travel Bucks™ Purchase and Travel Companion Registration Form.

15.6 The Travel Companion uses David Saint logo in any form of advertising or promotion without written consent from David Saint.

15.7 The Travel Companion uses David Saint’s name, trademarks, logos, or promotion of David Saint Advantage or Products via any media, including social media, without authorisation from David Saint.

16. INTELLECTUAL PROPERTY RIGHTS AND CONFIDENTIALITY

16.1 All intellectual property rights, including trademarks, trade secrets, copyrights, patents, marketing materials, and training documents relating to David Saint Advantage, Travel Bucks™ and Travel Bag remain the exclusive property of David Saint (Pty) Ltd. Travel Companions are granted a limited, non-transferable license to use such materials strictly as authorized and for the sole purpose of promoting Travel Bucks™ and Travel Bag in accordance with these Terms and Conditions.

16.2 The Travel Companion agrees to maintain strict confidentiality regarding all proprietary and confidential information disclosed during the course of participation, both during and after termination of membership.

16.3 Any unauthorized disclosure or misuse shall constitute grounds for legal action and/or termination.

16.4 Any unauthorized disclosure of trade secrets and/or confidential information may give rise to irreparable claims to accordingly, the Travel Companion undertakes, without limiting their obligations under common law to maintain confidentiality of these secrets.

16.5 Any trade secrets and/or confidential information in their possession or under their control shall be maintained under conditions of strict confidentiality.

16.6 The Travel Companion shall not, directly or indirectly, use for their own benefit or for the benefit of any other person, any trade secrets and/or confidential information.

16.7 The Travel Companion shall not disclose any trade secrets and/or confidential information to any other person without prior written consent of David Saint.

16.8 The Travel Companion shall not use or copy any of the trade secrets and/or confidential information for any purpose other than for performing their duties and obligations or exercising their rights in terms of the Terms and Conditions.

16.9 The provisions of this clause shall survive termination of membership in David Saint Advantage.

17. PROTECTION OF PERSONAL INFORMATION

17.1 By completing the Travel Bucks™ Purchase and Travel Companion Registration Form, the Booking Form and any other related platform or document which request any personal information, gives David Saint authority to collect and store Travel Companions' personal information as it is deemed relevant for David Saint to conduct its business.

17.2 David Saint complies with the Protection of Personal Information Act (POPIA) and other applicable privacy laws.

17.3 Personal information collected will be processed lawfully, transparently, and securely, solely for purposes related to the administration and operation of David Saint Advantage, Travel Bucks™ program and booking of packages in the Travel Bag.

17.4 The Travel Companion confirms that David Saint may share their personal information provided by them with the following, who have an obligation to keep the personal information secure and confidential:

Employees of David Saint who are required to be informed of the personal information in order to attend to Travel Companion's association with David Saint.
All third parties who may assist David Saint in supplying the services.

17.4 David Saint undertakes not to disclose Travel Companions' personal information unless it is legally or contractually required to do so.

17.5 David Saint agrees to use all reasonable efforts to ensure that Travel Companions' personal information in its possession is kept confidential, stored in a secure manner and processed in terms of POPIA.

17.6 Travel Companions therefore acknowledge and warrant that:

David Saint is entitled to process and store any personal information in the manner set out in David Saint Privacy Policy, available on this website.
David Saint is entitled and authorised to transfer any personal information to suppliers relevant to the booking of holiday and lifestyle packages in the Travel Bag.
David Saint is entitled to store and back-up personal information safely and securely.

18. GENERAL

18.1 These Terms and Conditions constitute the whole agreement between David Saint and the Travel Companion as to the subject matter hereof, and no agreements, representations or warranties between David Saint and the Travel Companion regarding the subject matter hereof, other than those set out herein and in the Travel Bucks™ Terms and Conditions are binding on the parties.

18.2 Either party may terminate the Travel Companion’s Membership in David Saint Advantage without cause by providing 14 calendar days’ written notice to the other party.

18.3 Following termination, the Travel Companion shall cease to earn Monthly Income, Travel Bucks™ Plus, Travel Bucks™ Xtra, Shopping Bucks, and any other benefits accruing post-termination date.

18.4 On termination the Travel Companion agrees to:

No longer represent themselves as a Travel Companion in terms of David Saint Advantage.
No longer in any way introduce prospective Travel Companions to David Saint.
David Saint servicing the Travel Companions within the Travel Companion's downline.

18.5 In addition and/or alternatively to the remedies available to David Saint in terms of these Terms and Conditions, or by law, David Saint is entitled to claim and recover damages suffered from the Travel Companion, and to the extent that it is not prohibited from doing so by any law, to set off its claim against any amount due to it by the Travel Companion, and the Travel Companion authorises David Saint to do so.

18.6 No addition to or variation, consensual cancellation of the Travel Companion's membership and no waiver of any right arising from the Terms and Conditions or its breach or termination shall be of any force or effect unless reduced to writing and signed by David Saint or its duly authorized representatives.

18.7 The expiration, cancellation, or termination of the Travel Companion's membership shall not affect those provisions of the Terms and Conditions which expressly provide that they will operate after such expiration, cancellation or termination, or which of necessity must continue to endure after such expiration, cancellation or termination, notwithstanding that the relevant clause may not expressly provide for such continuation.

18.8 Each provision of the Terms and Conditions or the Travel Companion Registration and Travel Bucks™ Terms and Conditions, and each part of any such provision, is separate and separable from the others.

18.9 If any provision in the Terms and Conditions, or the Travel Bucks™ Terms and Conditions, or any part of such provision is, becomes, or is declared by a court of competent jurisdiction or other competent authority to be unlawful, invalid or unenforceable for any reason, or in any jurisdiction, then it will, to the extent that it is unlawful, invalid or unenforceable, be severed from the Terms and Conditions or the Travel Bucks™ Terms and Conditions, and treated as if it had not been written, without invalidating or affecting the enforceability of the remainder of such provision or the remainder of the Terms and Conditions or Travel Bucks™ Terms and Conditions.
