1. INTRODUCTION 

1.1 These Terms and Conditions govern the relationship between David Saint (Pty) Ltd ("David Saint") and its Travel Companions regarding the acquisition (purchase and earning), accumulation and use of Travel Bucks™ as part of David Saint Advantage.​​

1.2 These Terms and Conditions form an integral part of the broader David Saint Advantage Terms and Conditions which cover the Compensation Plan, referral program, and related aspects.

1.3 By agreeing to these Travel Bucks™ Terms and Conditions, Travel Companions also acknowledge and agree to the David Saint Advantage Terms and Conditions.

2. INTERPRETATION 

In these Terms and Conditions,  unless inconsistent with or otherwise indicated by the context:

2.1 "Travel Bucks™" refers to the proprietary, non-transferable digital currency and unit of value issued and managed exclusively by David Saint (Pty) Ltd. Travel Bucks™ is integral to the David Saint ecosystem and is subject to the following specific terms:

• ​Nature and Purpose: Travel Bucks™ is created and designed solely as a digital currency for the exclusive redemption of holiday and lifestyle packages offered and available through the David Saint Travel Bag. It is intended to facilitate seamless travel bookings for active Travel Companions and their beneficiaries within our ecosystem.

• ​Non-legal Tender Status: Travel Bucks™ does not constitute legal tender, fiat currency, securities, cryptocurrencies, virtual currencies, or any other financial instrument in any jurisdiction. It is not regulated as such by any financial authority. It cannot be used for direct payment outside the David Saint ecosystem, nor is it convertible to cash, interchangeable with cash, or redeemable for cash or any other monetary instrument under any circumstances.

• ​Scope and Use: Travel Bucks™ can only be purchased through monthly subscriptions, earned, accrued, and redeemed within the David Saint ecosystem as expressly outlined in these Terms and Conditions and the accompanying David Saint Advantage Compensation Plan. It has no inherent monetary value outside of the David Saint platform and cannot be sold, transferred, assigned, gifted, or otherwise exchanged with any third party outside the defined internal mechanisms (if any) permitted by David Saint.

• ​Value and Redemption: The redemption value of one (1) Travel Bucks™ is generally equivalent to 1.25 South African Rand (ZAR) exclusively for the purpose of package redemption within the David Saint ecosystem. This redemption value is determined solely by David Saint at its discretion and may be subject to change upon prior notice as per these Terms and Conditions. All redemptions are subject to the availability of packages in the Travel Bag and applicable booking Terms.

• ​Management and Security: All funds corresponding to issued (purchased and earned) Travel Bucks™ are held securely in a dedicated Bank Trust Account established for this purpose, as further detailed in Clause 10, ensuring their availability is solely for package redemption as per these Terms and Conditions.

2.2 "Travel Bucks™ Plus" means bonus digital currency awarded to Travel Companions as part of David Saint Advantage Compensation Plan, holding the same value, use rights, and safeguarding as purchased Travel Bucks™, unless expressly stated otherwise.

2.3 "Travel Bucks™ Xtra" means Travel Bucks™ earned by Travel Companions as part of David Saint Advantage Compensation Plan, holding the same value, use rights, and safeguarding as purchased Travel Bucks™, unless expressly stated otherwise.

2.4 "Travel Bucks™ Fee" means the monthly subscription fee which is payable towards the purchase of Travel Bucks™ according to Travel Bucks™ Plan chosen by the Travel Companion.

2.5 "Travel Bucks™ Account" means the secure digital account where individual Travel Companion's Travel Bucks™, Travel Bucks™ Plus, and Travel Bucks™ Xtra are credited and accumulate, and from which they are redeemed towards the packages in the Travel Bag.

2.6 "Travel Bucks™ Plan" means a predefined monthly subscription category selected by a Travel Companion, which determines the amount of Travel Bucks™ credited to their Travel Bucks™ Account upon successful receipt of their appropriate Travel Bucks™ Fee.

2.7 "Travel Bag" means the catalogue of luxury holiday and lifestyle packages offered by David Saint.

2.8 "Travel Companion" means an individual who subscribes to the Travel Bucks™ program as well as sign up as a participant in David Saint Advantage.​

2.9 "Travel Bucks™ Management Committee" means an independent oversight body established by David Saint, which comprises among others Travel Companion representatives, to ensure the transparent, accountable, and secure management of Travel Bucks™ and Bank Trust Account and all related Travel Bucks™ operations, including the integrity of Travel Bucks™ value and the adherence to established fund protection policies.

3. ELIGIBILITY 

3.1  Travel Bucks™ purchase is open to all South African citizens and residents who are 18 years of age or older, and who sign up to become David Saint Travel Companions.

3.2 By participating in the Travel Bucks™ program, you confirm that all information you provide during registration is accurate and up-to-date.​

4. SUBSCRIPTION AND  PAYMENT TERMS 

4.1 Participation in the Travel Bucks™ program is inherently linked to enrollment in David Saint Advantage as a Travel Companion.

4.2 Travel Companions must select a Travel Bucks™ Plan and pay an appropriate Travel Bucks™ Fee as well as David Saint Advantage Membership Fee by Electronic Funds Transfer (EFT) into David Saint’s designated bank account.

4.3 Payments must be made in South African Rand (ZAR).

4.4 Travel Companions are responsible for any bank charges incurred during payment if payment is made through ATM deposit.​

5. TRAVEL BUCKS™ ACCOUNT MANAGEMENT 

5.1 Travel Bucks™ is credited to the Travel Companion’s Travel Bucks™ Account each month upon receipt of the relevant Travel Bucks™ Fee.

5.2 No Travel Bucks™ will be credited to the Travel Bucks™ Account if the Travel Bucks™ Fee is unpaid by the due date.

5.3 Travel  Bucks™ Account balances and transactions are accessible monthly through a Travel Bucks™ Statement.​

6. DUE DATE AND NON-PAYMENT 

6.1 Travel Bucks™ Fee is due each month by the 7th of each calendar month, covering the subscription period from the 8th of the preceding month to the 7th of the current month.

6.2 Failure to make payments by the due date will result in no Travel Bucks™ being credited to the Travel Companion’s Travel Bucks™ Account for that month.

6.3 David Saint reserves the right to suspend or terminate any Travel Bucks™ subscription if payments are missed for three (3) consecutive months. Upon such termination, the Travel Companion will cease to accrue new Travel ​Bucks™ and will no longer participate in David Saint Advantage.

6.4 Any Travel Bucks™ balance accumulated in the Travel Bucks™ Account prior to such termination shall remain valid and accessible for redemption towards the packages in the Travel Bag, in accordance with these Terms and Conditions.​

7. ACCOUNT TRANSPARENCY AND REPREPORTING

7.1 Travel Companions will receive monthly Travel  Bucks™ Statement which details all transactions including balances and credited Travel  Bucks™, Travel  Bucks™ Plus and ​​Travel Bucks™ Xtra.

8. CANCELLATION AND EXPIRY 

8.1  Should a Travel Bucks™ subscription be cancelled for any reason, the balance of the Travel Bucks™ (both purchased and earned) remaining in the Travel Companion's Travel Bucks™ Account shall not expire. The remaining Travel Bucks™ may be used by the former Travel Companion at any future time solely to book packages in the Travel Bag.

8.2 Travel Bucks™, including Travel Bucks™ Plus and Travel Bucks™ Xtra, held in the Travel Companion's Travel Bucks™ Account maintain their validity indefinitely, subject to its use for booking packages in the Travel Bag.

8.3  Travel Companions whose Travel Bucks™ subscriptions have been terminated may reactivate their subscription at any time to regain their Travel Companion status, benefits, including the ability to earn Monthly Income, Travel Bucks™ Plus and  Travel Bucks™ Xtra in accordance with the David Saint Advantage Terms and Conditions.

8.4 Travel Bucks™ subscription termination also implies that the Travel Companion is terminating their membership in David Saint Advantage.​

9. INSUFFICIENT TRAVEL BUCKS™

9.1  If a Travel Companion's Travel Bucks™ Account balance is insufficient to cover the required Travel  Bucks™ for a desired package, the  outstanding difference can be paid in South African Rands via EFT into David Saint’s designated bank account.

9.2 David Saint will provide a detailed breakdown of the required payment.​

10. SAFEGUARDING TRAVEL BUCKS™ FUNDS 

10.1 David Saint is committed to the highest standards of financial security for all Travel Bucks™, purchased and earned, held by Travel  Companions. To this end, all funds equivalent to the monetary value of outstanding Travel Bucks™ are held in a dedicated, legally separated Bank Trust Account. This Bank Trust Account is maintained entirely separate from David Saint's operational funds, meaning your Travel Bucks™ funds are never mixed with David Saint's operational capital.

10.2  David Saint strictly adheres to the 1:1 backing principle, guaranteeing that all Travel ​Bucks™ issued  to Travel Companions, including both purchased and earned Travel Bucks™,  are at all times fully backed by equivalent ZAR funds held in the aforementioned Bank Trust Account.

10.3 Funds in this Bank Trust Account are legally segregated from David Saint's operational funds and cannot be used for David Saint's general business expenses, thereby providing a safeguard against unforseen corporate financial collapse.

10.4 The management and oversight of the Travel Bucks™ Bank Trust Account and related operations are conducted by the Travel Bucks™ Management Committee (TBMC).

10.5 The TMBC comprises among others duly appointed Travel Companion representatives, to ensure transparent and accountable management of Travel Bucks™ value and adherence to robust operational procedures.

10.6 Travel Companions shall have the opportunity to vote for their representatives to serve on the TBMC during The Forum Annual General Meeting  (AGM).

10.7 The Forum AGM will also include presentations of key Travel Bucks™ financial reporting to Travel Companions, fostering transparency and accountability regarding the Bank Trust Account's performance and the status of outstanding Travel  Bucks™.

10.8 When booking a holiday or lifestyle package using Travel Bucks™,  Travel Companions must provide explicit authorization on the official booking form to debit the specified Travel Bucks™ from their Travel Bucks™ Account for the chosen package. Such authorization constitutes an instruction to David Saint to process the redemption of Travel Bucks™ for the specified package.

10.9 To ensure the security and integrity of all Travel Bucks™ redemptions and prevent unauthorized use, a robust, multi-step verification process is in place for all bookings made using Travel Bucks™. This process involves independent verification steps, including oversight by members of the TBMC, before funds are disbursed for supplier payments.

10.10 The Travel Bucks™ Bank Trust Account will be subject to annual external audits by an independent auditing firm to verify compliance with David Saint's fund management policies and the Travel  Bucks™ Management Policy.

10.11 David Saint commits to making a summary of these audit findings publicly avaliable to Travel Companions during The Forum AGM and on this website, enhancing overall trust and transparency.

10.12 All aspects of Travel Bucks™ management, including the operation of the Bank Trust Account, adhere to the applicable South African laws and regulations, including but not limited to, the Consumer Protection Act (CPA) and the Protection of Personal information Act (POPIA).

11. DORMANCY AND INACTIVE ACCOUNTS

11.1 Travel  Bucks™ does not expire and remains valid indefinitely for redemption towards Travel Bag packages.

11.2 If no activity (no accumulation or redemption of Travel  Bucks™) occurs in a Travel Companion's Travel  Bucks™ Account for twenty-four (24) consecutive months,  David Saint may classify the account as "Dormant".

11.3 Prior written notice will be sent to the Travel Companion’s last known email address.

11.4 If no response is received within thirty (30) days, the account may be temporarily suspended until verification is completed by the account holder.

12. DISPUTE RESOLUTION 

12.1 Any dispute regarding the Travel Bucks™ program must be submitted in writing by email to David Saint Travel Bucks™ Administrator at travelbucks@davidsaint.africa.

12.2 If unresolved, the dispute will be referred to arbitration in accordance with South African law.​​​

13. PROGRAM MODIFICATION AND NOTICE

13.1 David Saint reserves the right to modify, suspend, or terminate the Travel Bucks™ program, including but not limited to Travel  Bucks™ value, redemption process, or the structure of Travel  Bucks™ offerings.

13.2 Material changes will be communicated to the Travel Companions no less than thirty (30) calendar days prior to implementation via email and/or posting on our official website.

13.3 Where immediate change is required for legal, regulatory, or operational reasons, such changes may take effect immediately, with retrospective notice to affected Travel Companions.

 

14. FORCE MAJEURE

14.1 David Saint shall not be held liable for any failure or delay in performance of its obligations (including redemption of Travel Bucks™) due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, acts of government, pandemics, strikes, or failure of banking/payment systems.

15. ANTI-MONEY LAUNDERING (AML) AND FRAUD PREVENTION 

15.1 David Saint complies with applicable South African Anti-Money Laundering (AML) legislation, including Financial Intelligence Centre Act (FICA). 15.2 All Travel  Bucks™ transactions are monitored to detect and prevent potential money laundering, fraud, and other unlawful activities.

15.3 In the event of suspicious activity, David Saint reserves the right to freeze, block, or terminate any Travel  Bucks™ Account pending investigation.

15.4 David Saint may report such incidents to appropriate law enforcement or regulatory authorities without prior notice to the affected individual.

16. DATA PROCESSING 

16.1 All personal information collected and processed in relation to the Travel Bucks™ program shall be handled in accordance with David Saint Data Privacy Policy available on this website.

16.2 By agreeing to these Terms and Conditions, Travel Companions also consent to the data handling outlined in that policy.

17. GOVERNING LAW AND JURISDICTION 

17.1 These Terms and Conditions are governed and shall be construed in accordance with the laws of the Republic of South Africa.

​19.2 Any dispute arising from or relating to these Terms and Conditions shall fall under the exclusive jurisdiction of the courts of South Africa.
